经济适用房租赁合同效力研究——行政法角度
【摘要】住房问题是当今世界各国都面临的重要社会问题之一,因为它与老百姓的生活息息相关,问题解决的好坏,直接关系到一个国家的和谐与稳定。经济适用房制度是我国为解决中低收入家庭住房问题而采取的一项社会保障性质的政策,它是伴随我国住房制度改革的逐步推进,在原有的福利制住房制度退出历史舞台之后而推出的一项新型制度。但是,由于政府在对制度内容进行设计方面经验不足,加上市场上的许多不稳定不和谐因素的影响,经济适用房制度在产生之初就暴露出了较多问题.许多老百姓为了获得经济利益,将经济适用房用于出租。对此,上海法院面对经济适用房能否租赁问题,给出了正面答,使经济适用房租赁问题放到了台面上来。
