摘 要
劳务派遣型劳动模式作为经济发展到一定水平的产物,是时代发展的产物。劳务派遣作为一种新型的劳动关系,是市场经济条件下劳动力分配运用的新模式,与传统模式有者很大的差别。劳务派遣既然是一种新的雇佣模式,其发展的时间短,就必然存在一定的问题亟待解决。劳务派遣中存在的法律规定不健全、派遣机构审批不严格、劳动者“同工不同酬”、劳务派遣工作岗位界定不明确等诸多问题还有待解决。《劳动合同法》中对于劳务派遣的规定虽然具有一定的指导意义,但是还是不够具有针对性。劳务派遣制度问题的带来的问题严重影响着劳动力市场的稳定性,因此劳务派遣制度的问题亟待解决。针对劳务派遣制度问题,结合国内外经验,提出了以下完善方案。面对劳务派遣制度中出现的诸多问题,加强立法,严格执法,完善劳务派遣制度成为紧迫的市场保障。本文通过对我国劳务派遣制度的问题的研究,对我国劳务派遣制度问题的进行探讨。

ABSTRACT
Labor dispatch as a new type of labor relations, is the market economy under the conditions of using the new mode of labor distribution, and the traditional model has very big difference. Since labor dispatching is a kind of new employment mode, its development time is short, there must be some problem to be solved. Labor dispatching in the existing laws and regulations is not sound, dispatching intitution for examination and approval is not strict, worker “to get different pay”, labor dispatching work definition is not clear and so on many questions still to be solved. In the “labor contract law” to the provisions of the labor dispatching although has certain guiding significance, but still not have targeted. So, faced with many problems arising from the labor dispatch system, strengthen the legislation, strict law enforcement, and improve the system of labor dispatch as urgent market protection.
