土地承包经营权转让问题研究
摘 要
农村土地承包经营权的转让作为流转农村土地承包经营权的重要手段之一，除了具备农村土地承包经营权的流转所具备的一系列共性之外,还具备自身鲜明的个性特征。我国农村土地承包实行的经营权的转让，是开展有偿变动农村土地承包经营的权利、义务在整体上或部分上发生权力的根本转让的一种普通流转方式。因此，我国的有关法律对其有着十分严格的规定：的转让要经原始发包方的同意，而不是只需要到有关部门备案即可；土地经营权流转的期限是从原承包期限内所剩余的期限开始计算，不可以像转包、出租、更换和替耕等自行进行约定；土地经营权转让的双方有着严格的资格限定等。
但是，随着我国农村经济的不断发展，目前我国的农村土地承包经营权转让过程依然存在着土地经营权转让合同不够规范、转让不进行登记、转让给不从事农业生产的对象，土地经营权转让后因为权力何义务的关系不明而发生土地经营权转让民事纠纷等诸多的问题。这些存在的问题逐渐揭露出我国目前在农村土地承包经营权的转让制度方面存在着对土地经营权转让的必要条件、土地经营权转让双方的资格限制过多、对土地经营权转让后的有关主体的权利与义务的规定不十分明确、对土地经营权转让采取登记自愿的相关规定不合理等法律方面的缺陷。所以完善我国农村土地承包经营权的转让制度就具有了特别重要的意义，有利于我国的新农村建设。

These problems gradually exposed in our country at present rural land contract operation rights transfer system of the land operation rights transfer of the necessary conditions, to land management the transfer of the right to take the registration voluntary regulations is not reasonable and legal aspects of defects. So the improvement of China s rural land contract and operation right transfer system has the special significance, is conducive to China’s new countryside construction.
