论法官办案质量责任终身制
摘 要
人民法院司法体制改革正如火如荼地进行。司法责任制被誉为当代中国司法改革的“牛鼻子”。实行法官办案质量责任终身制是“让审理者裁判，由裁判者负责”的内在要求，是我国司法正义实现的途经之一。当前社会下，我国法官办案质量责任终身制在推动法治进程方面取得了一定成效，然而其缺陷也逐渐显露，倘若放任不管，审判权的行使必然会受到权责分离的阻碍，制约司法公正性与权威性的有效实现。因此，应当紧紧把握司法改革的主脉，以司法公正、高效、透明为追求，对法官办案质量责任终身制度予以反思、剖析。本文从四个方面逐层论述，第一部分主要介绍法官办案质量责任终身制的研究背景及研究意义。第二部分从法官办案质量责任终身制的字面含义深入，以法律的角度更直观的剖析法官办案质量责任终身制的深刻内涵。第三部分简述了当前法官办案质量责任终身制的形成路径。第四部分阐述了办案质量责任终身制存在的不足。第五部分针对前述问题，提出了解决的对策及建议，以期能为我国司法责任制的完善贡献绵薄之力。

Implementation of the quality responsibility of judges life tenure is “let the trial judge, the judge is responsible for” the inherent requirements, is one of China’s judicial justice through.Therefore, grasp the major directions of judicial reform to realize judicial justice and efficiency, it is necessary to judge he case handling quality lifelong responsibility system for the quality of life. The third part describes the current judges the law responsibility for the quality of life in our current legislation and in the latter part focuses on problems in the system. Part IV by the third part of the question, explore effective ways and to make recommendations to solve these problems, hope to be able to judge the quality of handling cases responsibility for life improvement and the modest contribution of judicial reform.
