【摘 要】人的各种利益关系在法律方面无不表现为权利和权力问题，因此，在当今各类社会问题中，首当其冲的就是要理顺权利与权力的关系问题。我国在改革开放后虽然进行了经济体制改革和逐步开展政治体制改革，但由于权利和权力问题没有随着改革的深入逐步梳理清楚，因此权利和权力在现实社会中遇到许多矛盾，权力可能损害权利的实现，影响权利发挥应有的作用，因此要加强对权力的制约和对权利的保护，因为这将直接涉及法律的尊严和权威，以及人们对法律的信仰与否。同时，解决权利和权力的关系问题，对于全面建设小康社会也具有重要的意义。
