论新闻报道与公众人物人格权的冲突
摘要
如今，随着经济全球化、信息全球化飞速发展，新闻报道也在逐步走进千家万户，互联网也成为了当今沟通交流、获取新闻报道、感知社会不可或缺的重要工具与途径。当我们打开多种多样网络媒体，只需按动键盘，点击鼠标，数不胜数的新闻报道、信息数据都将即刻映入眼帘。每一次新闻报道的输入、每一次图片的浏览都在不知不觉中为这个庞大虚拟世界的建造提供着取之不尽、用之不竭的丰富资源。新闻报道的网络大环境下，信息的快速流动使得公众人物获得更多信息的需求愈加强烈、传播渠道更加畅通、信息的采集更加高效便捷，然而公众人物的个人信息也越来越容易被非法搜集、滥用，这无形中给人格权的保护造成了隐患。人格权作为公众人物享有的重要的人格权利，其受保护的程度也是社会文明进步的标志之一。在我国，人格权作为一项列举的基本权利，但是由于相关法律保护上的缺位，在面临国家权力侵蚀的同时，公众人物也遭受着不同民事主体的侵害。本文将通过对当前中国法律体系——宪法中关于人格权的规定及问题进行论述，寻求我国在网络大环境下保护公众人物人格权的可行之道与解决方案。

Abstract
Nowadays, with the economic globalization, the rapid development of information globalization, news reports are also gradually into the tens of thousands of households, the Internet has become today’s communication, access to news reports, perception of social indispensable important tools and ways. When we open a variety of online media, just press the keyboard, click the mouse, countless news reports, information data will immediately greet the eye. Every time the news reports of the input, every picture of the browsing are unknowingly for the construction of this huge virtual world to provide inexhaustible and inexhaustible rich resources. News network environment, the rapid flow of information makes public people get more information needs more intense, more smooth communication channels, information collection more efficient and convenient, but the public figures of personal information is increasingly easy to be illegally collected , Abuse, which virtually to the protection of personality caused by hidden dangers. Personality rights as a public figure to enjoy the important personality rights, the extent of its protection is one of the signs of social civilization and progress. In our country, the right of personality as a listed basic rights, but because of the lack of relevant legal protection, in the face of state power erosion at the same time, public figures are also subject to different civil subject violations. This paper will discuss the provisions and problems of the current Chinese legal system – the constitution on the right of personality, and seek the feasible way and solution of protecting the personality character of the public in the network environment.
