论农地征收中现存的问题以及对农民权益的法律保护

摘要：目前，全国失地农民的数量己达4000万人，预计到2020年将达一亿。在社会主义新农村建设如火如荼进行的今天，随着工业化、城镇化步伐的加快，农村土地越来越多被征收。据估计，为维护社会公共利益需要，我国目前保护失地农民权益的机制还很不完善，我国土地征收制度越来越暴露出其不适应性，直接影响到农民的长远生计和社会的长治久安。为使我国的土地征收制度适应市场经济的要求，又能促进农地流转的农地制度体系，我国确立了土地征收制度，但实践中，土地征收过程中，损害农民权益及农民集体利益的情形时有发生，并对社会稳定产生了消极的影响。必须尽快建立一个既能确保适度管制，以更好地维护农民的合法权益。

Abstract: at present, the number of land-lost farmers throughout the country has 40 million people, is expected to reach one hundred million by 2020. In the socialist new rural construction in full swing today, along with speed up the pace of industrialization and urbanization, more and more rural land expropriation. It is estimated that needed for the social and public interests, currently the mechanism of protecting rights and interests of farmers in China is still very imperfect, land expropriation system in China is more and more exposed as inadaptability, directly affects the farmers’ livelihood and social stability in the long run. In order to make our country’s land expropriation system to meet the needs of market economy, and can promote farmland circulation of farmland system, established the system of land expropriation in our country, but in practice, the process of land expropriation, and damage the interest of farmers and the farmer collective interests, and have a negative impact on social stability. Must establish a can not only ensure that appropriate controls, as soon as possible in order to better safeguard the legitimate rights and interests of farmers.
