论我国夫妻约定财产制度的完善
【内容摘要】 社会经济发展极其迅速，社会财富不断增加，夫妻之间的日常收入也呈上升趋势，随之其财产的结构形式也更加多样。在当今世界，很多国家的法律明确规定了夫妻约定财产制度。而在我国，夫妻约定财产制出现相对较晚，相关法律条文的规定不系统、明确、完善，因此在社会上、司法实践中引发了一系列的问题。本文系统介绍了大陆法系和英美法系国家的夫妻约定财产制度，并同我国的夫妻约定财产制度进行对比研究，提出了我国的夫妻财产制度现存的一些不足，同大陆法系和英美法系的夫妻约定财产制进行比较分析，从而找出我国现行夫妻约定财产制的一些不足，并提出一些完善的建议。
【CONTENT ABSTRACT】 With the rapid development of social economy,the social wealth keep increasing and the daily income between the spouses has an upturn.Subsequently,the form of property structure is more diverse.In today’s world,the laws in many countries clearly stipulates the marital property system.However,In our country,it appeared so late that the provisions of relevant laws is not systematic,clever and perfect.As a result,in the society and judicial practices,it has caused a series of questions.This paper thoroughly introduced the agreed property system of the husband and wife in Continental Legal System and Common Legal System.And then,it carried and the comparation with and research for our mantal property system as well as put forward some problems existing in China’s marital property system.With the continental law system and common law marital property system and were compared and analyzed.This paper aims to find out some shortage of agreed prpperty system in our country’s present couples and offer some suggestions to iprove.
