浅析我国信访制度出现困境的根源
摘 要
信访制度市具有中国特色的政治参与和权利救济制度，在计划经济初期起到过一定作用，但现在信访案件居高不下，而且经常发生围堵党委和政府机关大门、交通要道的群访事件，社会影响很大。对各级党委政府的压力很大，信访工作空前受到重视，工作条件、人员配备都比以往要好，工作效率也很高，客观上起到党委和政府与人民群众沟通作用，也在力所能及的范围内解决了很多实际问题。但是，由于现行信访制度本身存在的缺陷，使信访制度逐渐扭曲甚至异化，但其实质上突显的是社会利益整合机制缺失与利益结构失衡的问题。仅仅靠信访制度来解决这个问题，在很多情况下无能为力，因而探索困境的根源，并进行合理的改革，才是走出困境的出路。

Analysis of the constitutional system of petition system in
China ‘s reform
ABSTRACT
The letters and visits system with Chinese characteristics, political participation and the right relief system in planned economy period, played a certain role, but now the cases remain high, and frequently contain Party committee and government bodies, gate, traffic group visit events, social influence. For the party committees at all levels of government pressure, the petition work unprecedented attention, working conditions, the staff are equipped with than ever before, the working efficiency is very high also, go up objectively the Party committee and government and people in the communication effect, also do everything in one’s power range to solve many practical problems. However, due to the current petition system deficiencies, making it on so many letters to struggle with, it is difficult to fundamentally solve the problem. Now all of the letters and visits system reform gave attention, this article through to the petition system in China ‘s present situation analysis, from the angle of constitutionalism presents to the Chinese petition system reform proposals.
