劳动合同经济补偿金制度研究
摘要
近年来,我国立法对《劳动法》、《劳动合同法》及其配套法律法规中的经济补偿金制度进行了有价值的修订,并在很多方面取得了重大突破,但从制度的实施来看,依然存在着诸多局限有待进一步完善。本文以经济补偿金的概念界定为起点,将经济补偿金的定义进行了系统的分析,同时深入探讨经济补偿金的性质、特征,并将其与相关概念进行比较,以期彻底并正确地理解经济补偿金的内涵。最后笔者对劳动合同经济补偿金制度中出现的问题做了总结,并提出了相关建议措施。

Abstract
In recent years, China’s legislation on the “labor law”, “labor contract law” and the supporting laws and regulations in the economic compensation system for valuable revision, and achieved a major breakthrough in many aspects, but from the implementation of the system, there are still many limitations have to be further improved. According to the concept of economic compensation is defined as the starting point, the definition of the economic compensation for the analysis of the system, and investigate properties, characteristics of economic compensation, and compare it with the related concepts, based on the connotation of period completely and correctly understanding the economic compensation. Finally the author on the problems of labor contract system of economic compensation are summarized, and put forward relevant suggestions and measures.
