孤儿作品的法律保护
摘要
孤儿作品是指仍受版权法保护，但是版权人不明或版权人虽然确定但是无法联系以获得其许可的作品。随着2009年谷歌图书扫描计划以及相关案件的发生再次将孤儿作品的利用和保护问题提上议程。近年来，包括美国在内的众多国家的学者纷纷着手对孤儿作品的合法利用的研究。但是在我国孤儿作品的利用以及保护并未受到足够的关注。在我国，孤儿作品的版权归国家和集体所有，对于孤儿作品的认定程序、权利人复出的表见性孤儿作品的版权清偿与责任承担等我国法律没有做任何规定。我国《著作权法》的现有规定不仅未能为解决问题该问题提供一个好的法律以及制度的支持，在实践中甚至导致了一定的适用混乱。因此，本文将立足我国国情，结合国外对于孤儿作品的规定来对我国孤儿作品的法律保护提出一定的修改建议，以此来完善我国孤儿作品的法律保护制度。

Abstract
Orphan works is still protected by copyright law, but the copyright person is unknown or copyright owners although established but unable to contact with permission from the works. As of 2009, Google Book scanning project and related cases will again be orphan works use and conservation issues on the agenda. In recent years, including the United States, many countries scholars begin to orphan works legally use research. But in our country the utilization and protection of orphan works have not been given sufficient attention. In our country, the orphan works belongs to the state and collective ownership, the orphan works that procedure, the rights of people to return the apparent orphan works copyright settlement and shoulder the responsibility in our country law did not make any provisions. Our country” copyright law” of existing provisions not only to solve the problem of the problem and provide a good legal and institutional support, in practice even leads to a certain application of chaos. Therefore, this paper will be based on the national conditions of our country, combine abroad to orphan works provisions to come to our country the legal protection of the orphan works put forward some suggestions, in order to perfect China ‘s legal protection system of orphan works.
