论古代死刑复核制度对现代的启示
摘要：随着我国的国力的不断的增强，越来越重视法律的健全，尤其是在死刑复核制度上，通过分析和研究可以知道，我国的死刑复核制度绝大部分都是通过我国古代死刑复核制度慢慢的吸取精华发展而来的。古代的关于死刑更改的途径有两种方式，分别是死刑复审和死刑复奏，在这两种形式中，死刑复审是非常的重要的，虽然说在古代统治者时期，主要是通过人制定的法律，具有一定的专一性但是在死刑复审方面还是有一定的借鉴的意义，通过对古代死刑复审制度的研究对现在的关于死刑复审制度的改进还是有一定的借鉴的意义，从中国古代死刑复审制度和现在制度的实质去比较，他们的本质是一样的，都是为了减少原价错案的发生率，毕竟人的生命是非常宝贵的,中国刑罚的产生和发展经历了一个从严刑峻法到不断文明的过程，与此同时死刑的适用也经历了一个由宽松到相对严格限制的过程。在不断的进行对死刑进行宣判的原则更改的时候，我国古代死刑的复核的方案也要随着进行去更改，我国古代统治者为了更好的使自己的统治更加的稳固，这时就出现了死刑复核的制度去更好的维护法律的公平性，更加有助于统治者的统治。
