随着经济全球化和国际私法趋同化的发展，公共秩序保留作为传统国际私法上的一项基本制度，也在走向新的历史阶段，对公共秩序的限制适用反映了各国在司法主权范围内公共秩序保留问题上的积极变化，它代表着传统的公共秩序保留制度在21世纪的发展趋势。对于公共秩序保留制度，我国一贯持肯定态度，在立法上有较完备的规定，并在司法实践中得到丰富和发展。但也应该看到，与当今国际社会的公共秩序保留制度的发展趋势相比，我国的公共秩序保留制度存在着一些缺陷与不足。
