随着通讯行业的迅猛发展,手机通讯服务中消费者权益受侵害的现象日益普遍,如手机短信的强制缔约,话费的不明不白,莫名的电话和短信,这些都严重地侵犯了人们的某些权利。对消费者的安全权,尤其是隐私安全与财产安全的侵害不容忽视。对消费者的知悉权与公平交易权的侵害也屡见不鲜。这些侵权行为主要有欺诈、强制交易、骚扰等几类,应从安全权、隐私权、安宁权等方面加强对消费者权益的保护,只有依法规范经营方的经营行为,规范手机通讯服务市场的秩序,才能维护手机通讯服务中消者的合法权益。加强手机通讯服务中消费者权益法律保护已成为当务之急。但理论界对这方面问题的关注不多,也没有相应的法律、法规规范,致使一些现象得不到解决。本文论述了手机通讯服务中的关于消费者权益的问题及侵权责任,并对手机通讯服务中存在的侵权行为提出相应的法律应对。

With the rapid development of the communications industry, mobile communications services in the interests of consumers against the phenomenon is increasingly common, such as mobile phone text messages forced contracting, the bill’s no apparent reason, inexplicable calls and text messages, these are serious violations of a people those rights. Consumers the right to security, especially in infringement of privacy and property safety can’t be ignored. Aware of the right of the consumer and fair trading rights infringement are not uncommon. These violations, fraud, forced transactions, harassment from the security, privacy, tranquility and the right to strengthen the protection of consumer rights, and only in accordance with the law to regulate the conduct of operations of the business side, the specification of the order of the mobile communications services market in order to safeguard the legitimate rights and interests of mobile communications services in the consumer. Strengthen the legal protection of the interests of consumers in the mobile communications services has become imperative. Theoretical circles in this regard concerns, there is no corresponding legal norms and regulations, resulting in some phenomena can’t be resolved. This paper discusses the interests of consumers in the mobile communications services and tort liability, the appropriate legal response to the violations and mobile communications services.
