论学校对未成年人人身伤害的责任承担

摘要：学校是未成年中小学生学习生活的主要场所，目前频繁发生的未成年中小学生在学校发生人身伤害案件已呈现逐年上升的趋势，成为社会关注的热点之一。如何正确界定学校对未成年中小学生在校伤害事故的民事责任，已成为司法实践中一个不容忽视的问题。本文试通过案例分析引起对学校承担责任的重视，接着分析了学校与未成年在校中小学生的法律关系界定问题，之后对学校承担责任的人身伤害的类型进行了阐述，列举了几种学校应承担责任的情况。接着文章对学校承担责任的归责原则进行了分析，之后论述了法律对学校承担责任的规定的不足，最后对完善学校承担责任的规定方面提出了一些个人见解，希望共同探讨学校对未成年人人身伤害的责任承担问题。
Abstract: the school is minor primary and middle school students to learn the main living place, the frequent occurrence of minor students in school of personal injury cases has been rising trend year by year, has become a hot social concern of. How to correctly define the school to minor students injury accidents in school ‘s civil liability in the judicial practice, has become a problem that can not be ignored. This article through the analysis of a case of school responsibility seriously, and then analyzes the school and minor elementary and middle school student’s legal relationship defining the problem, after the school responsibility personal injury types are expounded, several schools should bear the responsibility of the situation. Then the article on school responsibility imputation principle is analyzed, then the paper discusses the legal responsibility of the school provided inadequate, finally to improve the school responsibility provisions with respect to put forward some personal opinions, hopes to discuss the school to minor personal injury liability problem.
