Analysis of the unilateral termination of labor contract system
Abstract：Labor contract system is the core of the labor law, unilaterally dissolve the labor and employment contract system is one of the important contents. Improve the employment contract unilaterally terminate right system not only helps to achieve substantial justice, protect worker ‘freedom, promote the Labour reasonable allocation of resources, still can balance the interests of the parties to employment contracts, to the effective to perform labor contract, guarantee labor relations harmony and stability. Our country should adopt the advanced protection principle and coordination model, and the current legislation three kind of labor contract removes system, discusses the rationality. This article attempts to unilaterally terminate labor contract as the breakthrough point, to our country “labor contract law” after the implementation of the brief analysis unilaterally terminate, according to the labor contract law of the relevant provisions, and proposes some opinions of his own and improvement measures.
