摘要：随着性解放运动和人权运动的不断高涨，婚姻价值选择发生了巨大的转变，同性婚姻越来越成为理论界的一个争论点。人类婚姻制度史表明，当代婚姻不再只是为了生育下一代，伴侣间的感情基础是婚姻建立的基石。对当事人而言，婚姻关注的是两个人精神上的互相扶持而不再是过错、性和特权，其中更重要的是关注公平、平等、承诺和爱护。从理论上讲，更多的是考虑婚姻当事人之间的性别平等和婚姻自由。同性恋已经成为社会的重要话题，这表明同性恋的凸显挑战着原有的社会的存在体系，尤其是对同性恋认识态度的转变唤醒了对同性恋的权利认识，催生了同性恋者们的权利诉求。而我国著名性学教授李银河提出同性婚姻提案连续三次受挫，表明了我国同性婚姻法制的缺失和薄弱。那中国同性婚姻合法化还有多远?中国何时才能有健全的保障同性婚姻合法权利的法律体系？

Abstract：with the rapid development of sexual liberation movement and the human rights campaign, the choice of marriage has changed tremendously. Same-sex marriage has increasingly become a focus of the academic circles. The history of human marriage shows that the contemporary marriage is not for the inheritance. The spirit relationship has become the foundation of the marriage. For the two parties related, the focus of the marriage is the mutual spiritual support of the two partners rather than the mistake, sex or the privilege. On theory, people should care more about the equality、just、promise and love. The homosexuality has been an important social conversation, which demonstrates that the emergence of homosexuality has challenged the system of social existence. Particularly, the transformation in the attitudes towards homosexuality awakens the public’s awareness of the rights of the homosexual and thus spurs the appeal of the rights. However, the famous scholar on sex, Liyinghe, has been rejected for three times in succession on his Same-sex marriage proposal. This implies the defects and weaknesses of the legal system. How far is the way towards the legalization of Chinese same-sex marriage? When will China establish a sound and reasonable legal system to ensure the legal rights of same-sex marriage?
