近年来各种媒体的广告数量与日俱增,这其中有相当一部分的广告是由明星代言的广告,也不乏会有一些虚假广告,这些虚假广告严重损害了消费者的权益,明星在这行虚假广告中又扮演着重要的角色。本文将对明星代言虚假广告的法律责任进行分析,通过分析明星代言虚假广告的法理学依据,确定虚假广告责任的归属,现行法律中界定的虚假代言责任,对完善明星代言广告的法律责任制度提出了相关措施,对我国完善这方面的法律法规提供参考。

【 abstract 】 :Number of all kinds of media advertising is growing in recent years, there are quite a number of advertising is by this star endorsement advertising, there are some false advertising, the serious harm the rights of consumers, false advertisement star in this line of false advertising and plays an important role.This article will analyze the star endorsement of false advertisement legal responsibility, through the analysis of the jurisprudence basis of star endorsing false advertising, determine the responsibility on the ownership of the false advertisement, false endorsements responsibility defined in the current law, to improve the system of star advertisement legal responsibility put forward relevant measures, to perfect the laws and regulations in this field in China to provide the reference.
