摘要
随着我国汽车工业的迅速发展以及人民生活水平的提高，汽车产品在我国的普及程度也越来越高。但同时也引发了社会公众对于汽车质量安全问题的担忧，特别是缺陷汽车产品流入市场而引发的公共安全问题日渐成为社会关注的热点。
虽然我国对于缺陷汽车产品召回制度也有了一定的理论和实践经验，但尚未建立起体系完备、行之有效的汽车召回制度体系。由于缺乏足够的法律制度，缺陷汽车产品对于我国消费者利益的损害和对社会公共安全的威胁也越来越严重。因此，本文围绕缺陷汽车产品召回制度的有关问题展开论述。
本文共分为五部分，第一部门对缺陷汽车产品召回制度的相关概念进行了介绍，并阐述了该项制度所存在的价值和意义；第二部分对美国、日本、英国等发达国家的汽车召回制度进行了简要的介绍，并对相关国家的经验进行了分析和总结，为我国相关制度的构建和完善提供可参考的依据；第三部分对我国缺陷汽车产品召回制度的现状、存在的主要问题及完善建议进行了介绍，指出我国应该建立一个更加具有效率、更具可操作性的缺陷汽车产品管理平台，促进我国缺陷汽车产品召回制度朝着规范化、标准化、法制化的方向发展，从而更好地促进我国汽车工业的发展，保护我国消费者的合法权益和社会公共利益。

With the rapid development of China automobile industry and the improvement of people’s living standard, automotive products is also popularization in China’s. But at the same time, the quality of automobile safety will concerns for the public, especially for the defective automobile products into the market become a hot social concern , which has caused by the public security problem.
The defective automobile products recall system also has certain theoretical and practical experience, but has yet to establish a system of comprehensive and effective automobile recall system. Due to the lack of adequate legal system, the defective automobile products for our consumers benefit, and the social public safety threat became more and more serious. Therefore, this article discuss on the defective automobile products recall system concerned problem.
This paper is divided into five parts. the first sector introduced the concepts of the defective automobile products recall system, and expounds the value and significance of the system; the second part introduced automobile recall system of the United States, Japan, Britain and other developed countries, and analysis the experience of other countries, which provide reference basis for the establishment of related system for our country; the third part introduced the system of recall of blemish car product status, existing problems and improvement suggestions for our country, and points out that China should build a more efficient, more operable defective automobile product management platform, which to promote China’s system of recall of blemish car product change toward standardization, standardization, legal n. So as to promote the development of China’s automobile industry of our country, and we can protect the legitimate rights and interests of consumers and social public interest.
