全球范围内己有荷兰、比利时等21个国家通过法律承认同性婚姻的合法性，而我国同性婚姻的立法仍处于空白状态，使得我国很多同性恋者的权利无法得到保护。因此通过对我国同性恋现状的分析，提出同性婚姻合法化在我国实现的迫切性和必要性；同时从同性婚姻概念的阐释及同性婚姻特征出发，分析世界范围内同性婚姻合法化的进程及现状。目前我国同性婚姻合法化存在着社会层面、观念层面等障碍，运用三段式分析方法，从伦理道德、婚姻本质、子女抚养、法律、世界潮流趋向及国民观念等角度进行分析，同时在参照各国立法模式的基础上，综合比较提出适合我国的“伴侣式”的同性婚姻立法模式，并对同性伴侣成立的实质与形式要件、财产分配制、子女收养制等方面提出了具体的制度构想。

Abstract
Worldwide with the 21 countries, Netherlands and Belgium by the legitimacy of the legal recognition of same-sex marriage, and gay marriage legislation in our country is still in a blank state, make our country a lot of gay rights cannot be protected.So through the analysis of the status quo of homosexuality in China, and puts forward same-sex marriage is legalized in our country, the urgency and necessity of implementation;At the same time from the interpretation of the concept of gay marriage and gay marriage characteristics, analysis process and status quo of worldwide legalize same-sex marriage.Currently same-sex marriage is legalized in China there are obstacles, such as the social level, ideology, using a three-stage analysis method, from the ethics, the essence of marriage, child support, laws and trends in the world and the idea of national Angle analysis, at the same time in reference to the legislation pattern, on the basis of comprehensive comparison is put forward for our country’s “partner” same-sex marriage legislative mode, and founded the essence of gay couples and form important document, property allocation system, children adoption system aspects proposed the concrete system.
